Commercial General Liability Insurance (CGL)
Each practicing midwife in BC is required to carry CGL insurance in addition to malpractice insurance coverage.
Failure to comply with the requirement to have CGL insurance can result in loss of your MPP coverage.
CGL insurance is designed to protect midwives’ and their business when applicable, from financial loss should you be sued due to bodily injury or property damage caused by your services or business operations and not related to your delivery of professional services. For example, someone may slip and fall on a wet floor, or you may accidentally cause property damage to a patient’s home during a consultation. Learn more by watching this video.

Registration Requirement
The MABC office must receive proof of CGL insurance prior to processing new registration applications and during membership renewal.
Proof of CGL insurance in the form of a certificate of insurance must be provided at the time of membership renewal. The Certificate of Proof of CGL must include the items outlined in the Policy on CGL (PDF).

How is ‘Employee’ defined as it relates to CGL?
The definition of “employee” under the current policy is consistent with MABC’s expiring policy and is standard across CGL policy wordings and insurers.
Employee is defined as someone who is in the Insured’s service, who the insured compensates by salary, wages, or commissions, and who the insured has the right to direct and control while they are performing their services for the insured.
Persons who are volunteers, independent contractors, and others of the same general character are not employees.
To meet an insurer’s definition of an employee, the midwife must be:
working for the practice,
paid by the practice,
be working under the direction and control of the practice, and
not be a volunteer or independent contractor.
What about Locums?
As a locum, you may hold your own CGL policy. If you do not have your own policy, it is critical that you confirm with the host and/or clinic practice policy holder to confirm that you are covered. If you need more information about your specific scenario, we direct you to speak to an agent of BMS.
Do I need cyber insurance?
There is no mandate from MABC, BCCNM or the MPP provider that you have cyber insurance coverage. We however, are not insurance experts and highly encourage you to discuss your individual needs and risks with an insurance broker.
